Terms of Service

These Terms of Service (“Terms”) govern your access to and use of HostGuard Australia. By creating an account or using the service, you agree to be bound by these Terms.

1. Acceptance of terms

By accessing or using HostGuard Australia (“HostGuard”, “we”, “us”), you agree to be bound by these Terms, our Privacy Policy, our Risk Assessment Disclaimer and our Acceptable Use Policy. If you do not agree, you must not use the service.

2. User eligibility

  • You must be at least 18 years old and able to form a legally binding contract.
  • You must use HostGuard for legitimate hosting, short-term rental or property management purposes.
  • If you use HostGuard on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms.

3. Account responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, keep it up to date, and notify us immediately of any unauthorised use. We are not liable for losses arising from your failure to safeguard your credentials.

4. Subscription billing

Paid plans (Pro Host and Property Manager) are billed in advance on a recurring monthly basis in Australian Dollars (AUD) via Stripe. By subscribing, you authorise us to charge your payment method on each renewal date until you cancel. Full detail is set out in our Subscription & Billing Policy and Refund Policy.

5. Acceptable use

You agree to use HostGuard lawfully and in compliance with all applicable platform policies (e.g. Airbnb, Stayz, Booking.com), privacy laws, anti-discrimination laws and local short-term rental regulations. Prohibited conduct is described in our Acceptable Use Policy, which forms part of these Terms.

6. Platform limitations

HostGuard is a guidance tool only. It calculates a risk score from the booking characteristics you enter and may generate an AI summary. HostGuard does not:

  • Verify guest identities.
  • Guarantee booking outcomes or guest behaviour.
  • Operate as a blacklist or publicly expose guest names.
  • Share personal guest information between users.
  • Make booking decisions for you or replace your judgement.

7. Intellectual property

HostGuard, including its software, design, branding, scoring methodology and content, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the service for your internal business purposes. You retain ownership of the data you input; you grant us a licence to process that data to provide the service.

8. Service availability

We aim to provide a reliable service but do not warrant that HostGuard will be uninterrupted, error-free or available at all times. We may perform maintenance, update features, or suspend access for operational reasons. We are not liable for any unavailability outside our reasonable control.

9. Suspension and termination

We may suspend or terminate your account if you breach these Terms or our Acceptable Use Policy, if required by law, or to protect the service or other users. You may cancel your subscription or close your account at any time. On termination, your right to use the service ends, though provisions that by their nature should survive (e.g. liability, intellectual property) will continue.

10. Refunds

Subscription fees are generally non-refundable except as set out in our Refund Policy or where required by the Australian Consumer Law.

11. Limitation of liability

Nothing in these Terms excludes rights you may have under the Australian Consumer Law that cannot lawfully be excluded. Subject to those rights, to the maximum extent permitted by law, HostGuard and its operators are not liable for any indirect, incidental, special or consequential loss, or for any loss arising from your reliance on a risk score, AI summary or recommendation, including property damage, theft, nuisance, fraud, cancellations or financial loss. Where liability cannot be excluded, our total liability is limited, at our option, to re-supplying the service or refunding the fees you paid in the preceding three months.

12. Governing law

These Terms are governed by the laws of Australia and the State of Victoria. You submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.

13. Changes and contact
